  1. This Acceptable Use Policy (“Policy”) applies to your use of anything that we make available, including the Services, Website and APIs (collectively, the “Services”).             1. impersonate anyone or misrepresent your connection with any person or entity;
              1. use the Services to compete with us, or copy any ideas, features, functions, graphics of the Services;
                1. distribute any unwanted communication (e.g., using the Services to send spam);
                  1. use the Services for activities where use or failure of the Services could lead to death, bodily injury, damage to personal property, or environmental damage; or
                    1. access or use the Services in a manner intended to avoid incurring fees owed to us.

                    Content Restrictions.

                    1. We do not acquire any right, title and/or interest in the content material (including but not limited to text, User-provided software, scripts, trademarks, logos, HTML coding, domain names, links, graphics, audio, video, and any data) that you make available for use by means of our Services (collectively “Content”). You are solely responsible for all Content. Notwithstanding anything to the contrary in this Policy, Content is included in Confidential Information as defined in this Terms of Use, our entire obligation to keep Content confidential is stated in the Clause 11 (Confidential Information) as defined hereinabove. We shall not, intentionally (i) access Content or (ii) disclose Content to any third party, except to the extent: (A) You make your Content publicly available, (B) as necessary for us to provide or obtain third-party support for the systems or to provide information requested by you, or (C) as specifically authorized by you to us in writing.
                      You shall not upload or publish to the Services, or use the Services to distribute or create, anything that:
                      1. infringes, violates or invades the intellectual property rights of any third party;
                        1. is fraudulent, false, misleading, or deceptive;
                          1. is defamatory, obscene, pornographic, vulgar, or offensive;
                            1. promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group;
                              1. is violent or threatening or promotes violence or actions that are threatening to any person or entity;
                                1. promotes illegal or harmful activities or substances;
                                  1. is malicious or destructive, such as software viruses, worms, trojan horses, spyware, dishonest adware, scareware, crimeware, or any other malicious or destructive software of programs
                                    1. is illegal or solicits conduct that is illegal under laws applicable to you or us;
                                      1. violates the rights of others, including data privacy, confidentiality, and/or intellectual property rights;
                                        1. is or includes sensitive information subject to regulation or protection under Applicable Laws, including but not limited to Sensitive Data (for example, data relating to race, religion, politics, health, genetics, or sexual orientation);
                                          1. is or includes patient, medical, or other personal health information
                                            1. is or includes financial information, including but not limited to credit and debit card information;
                                              1. is or includes social security numbers or other government identifiers; or
                                                1. is or includes protected data about minors.
                                                If you violate this Policy, or encourage, allow or assist others to do anything to violate this Policy, we will take any action we consider necessary to protect ourself, our Users, and third parties. This may include quarantining or deleting data stored on the Services, or suspending your use or access to the Services. Please note that violation of this Policy may result in termination in accordance with our termination rights in the Terms of Use and any prevalent Service Order. You will not be entitled to any credit or other compensation for any interruption of the Services caused by your violation of this Policy.

                                                You shall be solely responsible for the Content and your SPI i.e. Sensitive and Personal Information, and the consequences of posting, publishing and printing it, and you agree that we are merely acting as a passive conduit for the your online processing of the Content and SPI on our Website.

                                              Transmission of Data.

                                              1. You understand that the technical processing and transmission of your electronic communications is fundamentally necessary to your use of our Services. You expressly consent to our interception and storage of electronic communications and/or SPI, and you acknowledge and understand that your electronic communications will involve transmission over the internet, including by cloud hosting and over various networks, only part of which may be owned and/or operated by us. You acknowledge and understand that changes to our electronic communications may occur in order to conform and adapt such data to the technical requirements of connecting networks or devices. You further agree that electronic communications may be accessed by unauthorized parties when communicated across the internet, network communications facilities, telephone, or other electronic means. You agree and acknowledge that any electronic communications and/or SPI which may be lost, altered, intercepted or stored without authorizations during the transmission of any data whatsoever across networks, including by way of cloud hosting may be attributable to third parties and will not be within our reasonable control.

                                              Data Deletion.

                                              1. Unless otherwise agreed-upon by the Parties in writing, We may permanently erase Content and SPI, if your account is delinquent, suspended, or terminated for 30 days or more. You agree that we shall not be liable to you or to any third party for any termination of your access to our Services or deletion of your Content and/or SPI.
                                            4. 6.

                                              Aggregated & Anonymized Data.

                                              1. Notwithstanding anything contained hereinabove, we may use Content and SPI, on an aggregated or de-identified basis and any data pertaining to location tracking, for research, analysis, profiling, and similar purposes in our sole discretion, including for the development and upgrade of our Services.
